Pantry E-Commerce App Terms & Conditions

1. Introduction

Welcome to Pantry, a mobile application owned and operated by CDG Energy Resources (‘CDG’), registration number 2020/770067/07.

By downloading or using the App, you agree to be bound by the terms and conditions outlined here.

We may update these terms from time to time. Any changes will be effective immediately upon posting, and continued use of the App after any modifications indicates acceptance.

2. Registration

To use certain features of the App, users must create an account. By registering, you confirm:

  • You are at least 18 years of age.
  • The information provided is accurate, up-to-date, and complete.
  • You will maintain the confidentiality of your login details.
  • You are responsible for all activities that occur under your account.

We are not liable for any loss or damage arising from unauthorized access to your account. If you suspect any breach of security, please contact us immediately.

3. Orders and Payments

Through the App, you can browse and purchase a range of groceries, food products, beverages, toys, gifts, flowers, and more, to be added from time to time. When you place an order, you agree to the following terms:

3.1 Order Process
  • Orders can only be placed via the App. No orders will be accepted via telephone, email, or any other medium.
  • Before completing your order, you must confirm your delivery address, product selections, and payment details.
  • All orders are subject to availability. If a product is out of stock, we may offer a suitable replacement.
  • Once your order is submitted and payment is confirmed, you will receive a notification confirming your order.
3.2 Payment Methods

We accept the following forms of payment:

  • Visa, MasterCard, and AMEX.

Prices listed include VAT unless otherwise stated. Final pricing may vary based on order adjustments such as weight-based products or product replacements.

4. Delivery

We deliver to selected areas as indicated in the App. Delivery charges and timelines will vary based on your location.

4.1 Delivery Terms
  • Delivery times are estimates, and we cannot guarantee delivery within a specified time frame due to unforeseen delays.
  • If the delivery address is incorrect or incomplete, we are not responsible for failed deliveries.
  • In case of adverse weather, accidents, or other events beyond our control, deliveries may be delayed or canceled. We will notify you and reschedule as needed.
4.2 Delivery Acceptance
  • Upon delivery, you or an authorized person must be available to accept the order. If no one is available, the order will be returned, and a credit will be applied to your account less the delivery fee.
  • For orders including restricted products (e.g., alcohol), valid identification may be required upon delivery. Alcohol will not be returned to the store for collection if no one over the age of 18 is present at time of delivery, ID will be required.

5. Delivery Restrictions and Conditions

5.1 Delivery Areas

Our delivery service is currently available in selected areas as permitted in the App. CDG reserves the right to modify the delivery zones without prior notice.

5.2 Delivery Restrictions

Delivery may be refused or delayed in cases where:

  • The delivery location is unsafe or poses a risk to our drivers.
  • There is no legal or accessible parking available near the delivery location.
  • The delivery location requires excessive walking distance from the offload point, such as high floors in buildings without elevators.
  • Repeated delivery attempts to the same address have failed for reasons beyond our control, such as restricted access in security complexes or incorrect contact information provided.
5.3 Incorrect Delivery Information

It is your responsibility to provide an accurate and complete delivery address. If incorrect information is provided, we are not liable for any failed or delayed deliveries. You will be charged for any additional attempts to redeliver the order.

5.4 Redelivery

If no one is available to accept the order at the designated delivery address, the driver will return the order to our facility, and a redelivery may be scheduled at an additional cost. Alternatively, you may cancel the order, but the delivery fee will not be refunded.

6. Risk and Ownership of Goods

6.1 Ownership Transfer

Ownership of the goods you order through Pantry will transfer to you at the time of delivery, once the items have been handed over to you or your designated recipient. Until that point, the goods remain the property of Pantry.

6.2 Risk Transfer

The risk of loss or damage to the goods passes to you upon delivery. Pantry is not liable for any damage, theft, or disappearance of the goods after the delivery is completed.

6.3 Refusal of Delivery

If, upon delivery, you notice that goods are damaged or incorrect, you have the right to refuse the delivery. The delivery driver will return the refused goods to us, and we will either arrange a replacement or credit your account.

6.4 Incorrect Orders

If an order is found to be incorrect after delivery, please report the issue via the App within 24 hours to receive a refund or replacement.

7. Returns, Refunds, and Cancellations

7.1 Returns and Refunds

If you receive a product that is damaged, defective, or not as described, you may return it for a full refund or replacement. Refunds will be processed within four business days.

Products must be returned in their original packaging. To initiate a return, please contact our support team through the App.

7.2 Order Cancellations

Orders are prepared, packed and dispatched on confirmation of the order. Cancellations or alterations will not be possible after an order is placed.

8. Privacy and Data Processing

We are committed to protecting your privacy. By using the App, you agree to the collection and use of your personal information as described in our Privacy Policy.

8.1 Data Collection

We collect personal information such as your name, contact details, and payment information to process orders, improve services, and communicate with you.

8.2 Data Sharing

We will not share your personal information with third parties except as necessary for processing orders, such as payment processors and delivery services.

8.3 Data Security

We implement reasonable measures to protect your personal information. However, no data transmission over the internet is completely secure, and we cannot guarantee the security of your information.

9. Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages arising from your use of the App or inability to access the App. This includes loss of data, profits, or any other harm resulting from the use or performance of the App.

Our total liability to you for any claim arising out of your use of the App or purchase of products shall not exceed the amount paid by you for the products in question.

10. Changes to Terms

We reserve the right to modify these terms at any time. Any changes will be posted on this page, and it is your responsibility to review these terms periodically. Continued use of the App after changes indicates acceptance.

11. Governing Law

These terms and conditions are governed by the laws of South Africa, and any disputes will be subject to the exclusive jurisdiction of the courts in Gauteng.

12. Rights

You agree that CDG may in its sole discretion transfer and/or assigned, part or all, of its rights to a third party.
